By accessing and using FIXARO (“the Platform”, “our Service”), you accept and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use our Service.

These Terms constitute a legally binding agreement between you and FIXARO (“we”, “us”, “our”) governing your access to and use of the FIXARO platform, including any content, functionality, and services offered through fixaro.pro and its subdomains.

By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

For the purposes of these Terms:

• “Client” means a user who posts job requests and seeks to engage Service Professionals through the Platform.
• “Service Professional” or “Professional” means a user who creates a profile advertising their skills and responds to job requests posted by Clients.
• “Job” or “Service Request” means a specific task or project posted by a Client on the Platform.
• “Direct Contract” means any agreement for the provision of services formed directly and exclusively between a Client and a Service Professional. FIXARO is not a party to any Direct Contract.
• “Lead” means a connection facilitated by the Platform between a Client and a Professional that may result in a Direct Contract.
• “User Content” means any content, including text, images, reviews, and other materials uploaded or posted by users.

Account Creation: To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised access at legal@fixaro.pro.

Account Types: FIXARO offers Client accounts and Professional accounts. Each account type has specific features, requirements, and obligations as detailed in these Terms.

Eligibility: The Platform is intended for users aged 18 or over who are legally permitted to perform or procure services in their jurisdiction. Service Professionals must hold any licences, certificates, or insurances required by law in their country of operation.

One Account Per User: Each natural person may maintain only one active account. Creating multiple accounts to circumvent Platform rules, reviews, or suspensions is strictly prohibited.

Intermediary Only. FIXARO operates exclusively as an online intermediary and lead-generation marketplace. Its sole role is to connect Clients seeking home-services professionals with independent Service Professionals who may be interested in performing those services.

FIXARO is not a party to any Direct Contract between a Client and a Professional. FIXARO does not employ, direct, supervise, subcontract, or act as agent for any Service Professional. The relationship between a Client and a Professional is entirely independent of FIXARO.

No Employment Relationship. Service Professionals are independent contractors. Nothing in these Terms creates or implies any employment, agency, partnership, joint-venture, or franchise relationship between FIXARO and any Service Professional.

No Guarantee of Quality or Outcome. FIXARO does not screen, verify the professional qualifications of, endorse, or guarantee the work quality of any Service Professional. Users engage professionals entirely at their own risk and are solely responsible for assessing suitability before entering into a Direct Contract.

Service Listings. Professionals may create profiles and publish their service offerings on the Platform. All listings must be accurate and comply with applicable law. We reserve the right to remove any listing that violates these Terms.

Job Postings. Clients may post job requests describing the services they need. Job postings must be lawful and accurate. FIXARO reserves the right to remove job postings that violate these Terms.

Matching. The Platform uses algorithms to surface potentially relevant Professionals to Clients based on factors including location, category, and profile completeness. FIXARO makes no representation that any match is suitable for a particular task.

Free Beta. FIXARO is currently operating in a free beta phase. During the beta, access to the Platform — including the creation of Client and Professional accounts and the posting and responding to job requests — is provided free of charge.

No Payment Processing. FIXARO does not process payments between Clients and Professionals. Any financial arrangements — including pricing, payment method, and timing — are agreed directly between the Client and the Professional outside of the Platform.

Future Pricing.We intend to introduce paid plans or platform fees after the beta period ends. We will provide at least 30 days' prior notice via email and a prominent notice on the Platform before any fees take effect. Continued use of the Platform after fees take effect constitutes acceptance of those fees.

Taxes. Each user is solely responsible for determining and paying any taxes applicable to their own activities. Service Professionals operating as businesses are responsible for their own VAT, income tax, and social security obligations.

Ownership. You retain ownership of all content you post on the Platform. By posting content, you grant FIXARO a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute your content solely in connection with operating and promoting the Platform.

Content Responsibility. You are solely responsible for all content you post. You warrant that you own or have the necessary rights to post your content and that it does not infringe any third-party rights or applicable law.

Prohibited Content. You may not post content that is illegal, offensive, discriminatory, defamatory, or that infringes on intellectual property rights. We reserve the right to remove content that violates these Terms without notice.

Reviews and Ratings. Users may leave reviews after engaging through the Platform. Reviews must be honest, accurate, and based on genuine experience. Fake reviews or review manipulation is strictly prohibited.

You agree not to engage in any of the following:

• Violating any applicable laws or regulations
• Infringing on intellectual property or other third-party rights
• Posting false, misleading, or fraudulent information
• Harassing, threatening, or discriminating against other users
• Creating fake accounts, impersonating others, or manipulating reviews and ratings
• Using the Platform to solicit users to transact outside of it in order to circumvent any future platform fees
• Scraping or data-mining the Platform without written permission
• Interfering with the Platform's security, infrastructure, or functionality
• Using the Platform for spam, phishing, or distribution of malware
• Any other illegal or unauthorised purpose

Platform Provided “As Is”.The Platform is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

No Liability for Direct Contracts. Because FIXARO acts solely as an intermediary and is not a party to any Direct Contract between a Client and a Professional, FIXARO is not responsible for: the quality, safety, or legality of services performed; any injury, property damage, or financial loss arising from a Direct Contract; any dispute between a Client and a Professional; or the failure of either party to perform a Direct Contract.

Limitation of Damages. To the maximum extent permitted by applicable EU law, FIXARO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with these Terms or the Platform.

Cap on Direct Liability.FIXARO's total aggregate liability to you for direct claims arising out of or in connection with the Platform shall not exceed €100 or the amount you have paid to FIXARO in the twelve months preceding the claim, whichever is greater. During the free beta period, the cap is €100.

EU Consumer Rights Preserved.Nothing in this section limits or excludes liability for death or personal injury caused by FIXARO's negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable EU or member state law.

Between Users. Disputes arising out of a Direct Contract are the sole responsibility of the Client and Professional involved. FIXARO may, at its discretion, provide a messaging channel or other informal assistance, but has no obligation to mediate and no liability for the outcome.

With FIXARO. If you have a dispute with FIXARO, please first contact us at legal@fixaro.pro. We will attempt to resolve the matter informally within 30 days.

Governing Law. These Terms are governed by and construed in accordance with the laws of the European Union and the member state in which FIXARO is established, without regard to conflict-of-law principles. Consumer users retain the right to seek redress before the courts of their country of habitual residence.

EU Online Dispute Resolution.If you are an EU consumer, you may also submit a complaint via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Termination by You. You may terminate your account at any time by contacting us at legal@fixaro.pro or, once available, using the account-deletion feature in your account settings. Deletion of your account does not affect rights or obligations incurred prior to termination.

Termination by Us. We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct we reasonably believe violates these Terms, is harmful to other users, or is otherwise harmful to FIXARO or third parties.

Effect of Termination. Upon termination, your right to access and use the Platform will immediately cease. We may delete your account information and content, subject to our data-retention obligations under applicable law and our Privacy Policy.

Survival. Sections 6 (User Content — licence), 8 (Limitation of Liability), 9 (Dispute Resolution), and any other provisions that by their nature should survive termination will continue to apply after termination.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email to your registered address and by a prominent notice on the Platform at least 30 days before the changes take effect.

Your continued use of the Platform after the effective date of revised Terms constitutes acceptance of those changes. If you do not agree to the modified Terms, you must stop using the Platform before the effective date.

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and FIXARO concerning the Platform.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited to the minimum extent necessary so that the remaining Terms remain in full force and effect.

No Waiver:FIXARO's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. FIXARO may freely assign these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure: FIXARO shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control.
